Terms & Conditions


General

These terms & conditions shall be incorporated into & govern this agreement made between AutoLyne Ltd & the renter whose names and addresses are set out within the rental agreement to the exclusion of any other terms and conditions, Words & expressions defined shall where applicable have the same meanings when used herein. In addition, the term “vehicle” when used herein shall (if applicable) be deemed to include any replacement vehicle and all tyres, tools, accessories, parts and equipment relating to vehicle. Where the person signing this agreement on behalf of Renter is not the Renter, they represent and warrants to AutoLyne that they are authorised to sign and to enter into this agreement for and behalf of Renter and all agreements and obligations on the part of Renter hereunder shall be deemed to be made by such person jointly & severally with Renter

Hire of Vehicle

AutoLyne agrees to let & Renter agrees to take on hire vehicle upon and subject to the terms and conditions of this agreement The period of hire shall commence on the time and date “out” on rental agreement & shall continue (subject to early termination by either party, or any extension in accordance with this agreement) until the authorised time the vehicle is due back. The period of hire cannot be extended without AutoLyne’s written consent The period of hire cannot extend beyond 90 days on one agreement in any circumstances (second agreement will need to be raised beyond 90 days)

Prohibited Uses

Renter will not use Vehicle or allow Vehicle to be used for any purpose for which it is neither designed, suitable nor hired including (without limitation) the carriage of passengers for hire or reward, any unlawful, hazardous or unusual purpose, propelling or towing any other vehicle or trailer or for any similar purpose without AutoLyne’s written consent; racing, rallying, pace making, reliability, speed testing or other trials, competitions of any sort or driving tuition; carrying a number of passengers and/property which would cause vehicle to be overloaded or would cause any applicable restriction to be exceeded; the use of vehicle on any surface other than roads with a tarmacadam or concrete surface over which there is a right of way (public or private) for motor vehicles Renter will not allow vehicle to be driven by any person who has not been approved in writing by AutoLyne Renter will not take or allow vehicle to be taken outside of the United Kingdom without AutoLyne’s prior written consent. Only countries detailed on the supporting travel documents can be visited. Travel to or through any other country without proper written approval will breach this agreement. As a pre-condition of any consent renter must produce to AutoLyne evidence satisfactory to AutoLyne of adequate insurance arrangements for taking vehicle abroad including (without limitation) an international motor insurance card (“green card”) and/or Bail bond (as the case maybe). Renter will not use any vehicle over 3500kg for business use without a full & valid current operator’s licence The renter will not allow the vehicle to be driven in breach of any speed limits or any other highways legislation of the country in which the vehicle is being used. The renter will not tamper or interfere with the telematics device fitted to the vehicle

Payments

Renter will pay to AutoLyne on demand……
The anticipated rental & mileage costs & the agreed excess (which will be described as the sum of deposit plush rental payment made), with any further payments requested by AutoLyne on or before the extension of the period of hire, which AutoLyne may apply at any time towards payment of any sums due from renter hereunder; unless AutoLyne has agreed to allow the renter to rent vehicle without lodging the amount in advance. Where the total has not been paid in advance, the renter agrees to pay AutoLyne on receipt of invoice according to the credit terms on invoice. The rental & mileage charges calculated are deemed to have been covered by the vehicle from the commencement of the hire until the vehicle is returned to AutoLyne in accordance with the terms of this agreement as recorded by the odometer installed in vehicle when received provided that if the odometer has failed or malfunctioned or has been interfered with in any way the mileage charge shall be estimated by AutoLyne in its absolute discretion. The amounts (if any) specified are for time charges, collision damage waiver. Insurance or other charges, All fines, penalties, costs, charges, and liabilities relating to parking, road traffic or other offences or contraventions or restoration charges and loss of income if vehicle is seized by customs and excise or needing repair incurred in relation to vehicle by renter or AutoLyne (except where caused through fault of AutoLyne), from the commencement of this agreement until the vehicle is returned to AutoLyne in accordance with the terms of this agreement by the nominated payment method stated within rental agreement regardless of the time lapsed between offence and notification of any offence to AutoLyne, and renter will allow AutoLyne to process credit or debit card transactions for these amounts plus a reasonable administration fee of £35 inc vat. AutoLyne’s cost of repairing or replacing vehicle in the event of loss, theft or damage howsoever caused, plus loss of revenue to AutoLyne (calculated at AutoLyne’s standard charges for the period during which vehicle shall remain unavailable for rental by reason of such matters) provided that if vehicle is operated in accordance with all the terms of the agreement

Renters liability in respect of damage to or theft of vehicle would be limited to a non-waivable excess charge in accordance with AutoLyne’s current tariff as specified in rental agreement, except where the damage or theft has been caused by the negligence of the renter Renter is fully responsible for cost of refuelling the vehicle if returned to AutoLyne with less fuel than contained in vehicles fuel tank at the commencement of the period of hire, together with AutoLyne’s £25 fuel admin charge

AutoLyne’s costs incurred in recovering vehicle in the event that renter fails to return it to AutoLyne in accordance with the terms of this agreement Any VAT or local taxes/expenses payable in respect of any of the above

All overdue payments shall bear interest on the amount overdue, and AutoLyne reserves the right to charge administration & recovery fees Renters Obligations (renter shall during the agreement)

Take proper care of vehicle & ensure vehicle is used in a lawful and reasonable manner in all respects and in particular (without limitation) will keep vehicle locked when not in use and shall ensure that ignition keys and/or security arming devices are not left in the vehicle when unattended Return vehicle to AutoLyne within AutoLyne’s opening hours in the same condition as when as when received as evidenced by renters signature on vehicle condition report relating to vehicle (fair & tear only excepted) to AutoLyne’s address immediately upon demand by AutoLyne (such a demand not to be made without reasonable cause), subject to a refund to renter of any sums already paid by renter in excess of those due under the terms of this agreement Immediately report any accident, loss, or damage involving vehicle to AutoLyne and the police or other proper authority and at AutoLyne’s request complete AutoLyne’s accident report form without delay, Immediately report any breakdown, fault or defect reasonably requiring repair to AutoLyne and will not in the case of a defect or fault which makes vehicle unroadworthy or liable to cause damage or danger to persons or property or further damage to vehicle, use vehicle until fault of defect has been repaired or corrected and will take all reasonable stops to prevent or mitigate any loss or damage occurring to vehicle

Obtain AutoLyne’s written consent before incurring any repair costs. Not remove or interfere with any vehicle parts or spares or with any identification marks or plates affixed to vehicles, Inform AutoLyne immediately upon request of the whereabouts of vehicle Not sell, mortgage, charge, pledge, assign, underlet, lend, or otherwise deal with vehicle in any manner in any manner inconsistent with AutoLyne’s rights. Maintain all oil, other fluid levels & tyre pressures in accordance with the manufacturer’s recommendations. At AutoLyne’s request, assist AutoLyne in enforcing any rights or remedies AutoLyne may have against 3rd parties in respect of any loss or damage to or in connection with vehicle arising during the term of this agreement

Limitation of Liability

AutoLyne warrants that from the commencement of hire… To take all reasonable steps to provide the renter with a well-maintained vehicle When informed of a breakdown by the renter to see that the necessary repairs are carried out promptly if possible Where repairs cannot be carried out promptly, to provide a substitute vehicle or allow the renter to terminate hire All other warranties, conditions or terms relating to contracts of hire & whether implied by statute or common law or otherwise are excluded to the fullest extent permitted by law. In particular (but without limitation) AutoLyne shall not be liable to renter for any indirect or consequential loss or damage (including loss of revenue), costs, expenses, liabilities or any other claims or demands arising out of or in respect of any breakdown, malfunction, failure or defect of vehicle. Any property left, stored or transported by renter or any other persons in or upon vehicle either before or after the return of the vehicle to AutoLyne. Provided always that nothing herein contained shall restrict or exclude AutoLyne’s liability for death or personal injury caused by AutoLyne’s negligence or any other liability of AutoLyne which cannot be excluded as a matter of law

Insurance

Except where renter has elected personally to insure vehicle, as evidenced by renter’s signature in the rental agreement. Renter participates as an insured under AutoLyne’s “on hire/rental” insurance policy & agrees to observe all the terms & conditions thereof. A summary of the terms & conditions of such insurance policy is available for inspection at AutoLyne’s address. Renter further agrees to protect the interest of AutoLyne and AutoLyne’s insurance company in the case of an accident during the term of this agreement by a) making every endeavour to obtain names & addresses of parties involved and of witnesses b) not admitting liability or guilt to any third party c) not abandoning vehicle without adequate provisions for safeguarding & securing the same d) calling AutoLyne’s office by telephone to report any incident and further completing a detailed report inc pics, plans and drawings to AutoLyne e) notifying the police or other proper authority immediately. Where renter has elected personally to insure vehicle (evidenced as aforesaid), renter undertakes to insure and keep insured vehicle during the term of this agreement under a fully comprehensive motor insurance policy (including windscreen damage) to its full replacement value, free from limitation or excess, with reputable insurers approved in writing by AutoLyne. Renter agrees to observe all the terms & conditions of the said policy. Renter shall at AutoLyne’s request supply full details of such policy to AutoLyne and shall ensure AutoLyne’s interest in vehicle is endorsed upon the said policy. Renter shall procure that any money paid by renter insurers under the said policy is paid directly to AutoLyne and renter shall compensate AutoLyne for any loss or damage suffered by AutoLyne in excess of any monies received by AutoLyne

Indemnity

Renter will indemnify and hold harmless AutoLyne and covenants to pay AutoLyne and keep AutoLyne indemnified and held harmless against all costs, losses, claims or damages, expenses & liabilities of whatsoever nature suffered, incurred or sustained by AutoLyne as a result of or in connection with a) any breach by renter of any of the provisions of this agreement and b) any loss or damage to property left, stored or transported by renter or by any other person in or upon vehicle either before or after return of vehicle to AutoLyne. Provided that this indemnity shall not apply to any liability of AutoLyne for death or personal injury caused by AutoLyne’s negligence or any other liability of AutoLyne which cannot be excluded as a matter of law

Termination

If renter commits any breach of this agreement; or if any statement, representations or warranty made by renter in the rental agreement in these terms & conditions in respect of himself or any additional driver is incorrect or if a receiving order is made or a petition in bankruptcy is presented against renter (or being a company, renter goes into liquidation whether voluntarily or compulsorily a receiver, administrator or manager shall be appointed over the whole or part of the business assets), or if renter offers to make any arrangement with its creditors or if any distress or execution is levied against any of its goods; then in any such event AutoLyne may terminate this agreement forthwith but without prejudice to any of AutoLyne’s accrued rights and remedies against renter. On the expiry or termination of this agreement, howsoever occasioned, renter shall no longer be in possession of vehicle with AutoLyne’s consent and renter shall forthwith return vehicle in same condition as when received as evidenced by renter signature on AutoLyne’s “vehicle condition report”, relating to vehicle. Provided that under no circumstances shall renter return vehicle to AutoLyne’s normal published working hours without AutoLyne’s prior written consent. If renter commits any breach of this agreement, AutoLyne may, without notice, retake possession of vehicle together with the insurance certificate & any other documents of AutoLyne & for such purpose may enter upon any premises belonging to, or in the occupation of the renter

Data Protection Act

The information the renter provides in conjunction with the hire of the vehicle will be used by AutoLyne to fulfil the contract that the renter places and to maximise the efficiency of processing of any order placed in the future. If the renter is taking out insurance for the rental through AutoLyne, the renter acknowledges and agrees that its personal data (including personal date such as health/conviction details) may be passed to AutoLyne’s insurers (solely for the purposes of assessing the insurance risk of the renter) The renters data will not be passed onto any other party without renters permission. AutoLyne may use your details to inform you of offers and services that AutoLyne can support you with in the future. AutoLyne will provide a vehicle which is fitted with a tracking device, which will advise AutoLyne of the vehicle’s location & may be used a s a tool for measuring how the vehicle is being operated and whether it is being operated in accordance with the relevant highways legislation. AutoLyne may contact you if the device indicates that you may be breaking the law or operating the vehicle in a dangerous fashion. These terms and conditions constitute the entire agreement and understanding between the parties hereto & no variation to this agreement will be binding unless agreed in writing by AutoLyne
